This study explores how the law holds children accountable for crimes, particularly in cases where a child deliberately guides another child to engage in sexual intercourse. The focus is on legal protection for children in conflict with the law, criminal sanctions imposed on child offenders, and the application of restorative justice principles in the juvenile justice system. In this case, the legal framework is based on Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA) Study of Decision Number 3/Pid.Sus-Anak/2023/Pn Mdn, which prioritizes diversion, a process that resolves cases outside the courtroom—and upholds the principle that punishment should be a last resort. Additionally, Law Number 17 of 2016 on Child Protection serves as a key reference in determining whether the elements of a criminal act are met. The findings reveal that the judge carefully considered multiple factors before delivering a verdict, including the offender's age, the psychological impact on the victim, and the principle that punishment for children should focus more on rehabilitation and recovery rather than mere penalization. This approach aligns with international standards, such as the Convention on the Rights of the Child, which Indonesia has ratified.
